Preamble

We pay particular attention to protecting the privacy of visitors who access the DAILY CODE website, as well as those whose personal data were provided to us by a third party, or to which we had access from another source, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 regarding the protection of individuals with regard to the processing of personal data and the free movement of such data (hereinafter referred to as "GDPR").

The new law of the European Union regarding the protection of personal data, GDPR ("General Data Protection Regulation") entered into force on May 25, 2016, starting to produce its effects on May 25, 2018.

This policy explains DAILY CODE's practices regarding the application of the provisions of the GDPR, as well as the rights you enjoy regarding the way in which your personal data is processed by DAILY CODE. Through this policy, DAILY CODE wishes to inform the persons concerned about the nature of the personal data that we collect and process, as well as about the purposes of the processing.

What is personal data?

"Personal or personal data" means any information or information that can identify you directly (for example, your name) or indirectly (for example, through pseudonymous data or a unique identification number). This means that personal data includes your e-mail address, address, mobile phone, username, information on your financial situation or even the IP address of your computer.

What personal data processing means?

"Processing" means any operation or set of operations performed on personal data or sets of personal data, with or without the use of automated means, such as collection, recording, organization, structuring, storage, adaptation or modification, extraction, consultation, use, disclosure by transmission, dissemination or making available in any other way, alignment or combination, restriction, erasure or destruction.

The basis and purposes of personal data processing

I. In order to conclude and execute contracts - In order to be able to offer you our products and services, we need to process personal data belonging to you, with the following purposes:

i. Informing customers/buyers regarding the status of their account, if any, including validating, shipping and invoicing orders, resolving cancellations or problems of any nature related to an order, the goods and/or services purchased/contracted.

ii. For marketing purposes, personal data may also be processed if the data subject has given his consent for the processing of his personal data, for one or more specific purposes. Thus, in certain situations, your personal data will be used for the purpose of sending you marketing messages, offers, news, announcements about future campaigns, invitations to various events, market research, sales tracking and monitoring and of the customer/buyer's behavior, by sending periodic newsletters and/or alerts, by using electronic mail (e-mail, SMS), etc.

II. In order to fulfill some legal obligations, we request a series of personal data, including, in certain situations, the personal numerical code, for example to fulfill the obligations imposed by the fiscal authorities in relation to invoicing and reporting to these authorities.

Processing the contact form (if exists)

DAILY CODE will use the information you provide in the corresponding Contact section, available on the website, exclusively for the purpose of processing your request. By providing any personal data through the DAILY CODE website, you understand and agree that your data will be processed in accordance with the provisions of the GDPR.

DAILY CODE undertakes not to process the personal data provided for a purpose other than that for which they were transmitted, except for situations where there is your express consent to use them for other purposes.

Disclosure of personal data to third parties

The personal data processed by DAILY CODE may be disclosed and/or transferred to third parties only in the situation where there is your express consent to proceed in this sense, with the exception of situations in which there is a legal obligation to proceed in this way .

Also, DAILY CODE can provide the personal data of the buyer/client to other companies with which it is in a partnership relationship, but only on the basis of a confidentiality commitment from them, by which they guarantee that these data are kept safe and that the provision of this personal information is done according to the legislation in force, as follows: courier service providers, marketing service providers, payment/banking service providers, insurers.

Data processing by third parties, other websites and sponsors (where applicable)

The DAILY CODE website may contain, at a given moment, access links to other sites whose data processing policies may be different from those presented here. Please consider and consult the personal data protection policies of the other sites, DAILY CODE not assuming responsibility for the personal data collected by these third parties.

Automatic data processing. Cookie(s)

The DAILY CODE website uses cookie identifiers. In this regard, you can consult our Cookie Policy, available on the website, and if you wish, you can exercise your right to disable Cookies.

Data storage period

We will keep the processed data for different periods of time, judged to be reasonable, in accordance with the previously indicated purposes. We keep your data only for the period necessary to achieve the purpose for which we hold the data, to satisfy your needs or to fulfill our obligations imposed by law.

To know how long your data can be kept, please keep in mind that we use the following criteria and parameters:

a. When you purchase products and services, we keep your personal data for the duration of our contractual relationship;

b. If you participate in a promotional offer, we keep your personal data for the duration of the promotional offer;

c. If you contact us with a question, we keep your personal data for the duration necessary to process the respective question, but no more than 5 years from the last correspondence sent;

d. If you create an account, we keep your personal data until you request to delete them or after a period of inactivity (without an active interaction with us). In this sense, we mention that the data processed for this purpose will be deleted after 5 years from the last interaction with the account user (such as, for example, logging into your account);

e. If you have given your consent for marketing, we keep your personal data until you unsubscribe or request to delete them or after a period of inactivity. In this sense, we mention that the data stored in our databases for the purpose of marketing communications are deleted from the records of these databases upon the completion of 5 years from the last interaction with you;

f. If cookies are stored on your computer, we keep them for as long as necessary for them to achieve their purposes (for example, during a session for shopping cart cookies or ID cookies session hours) and for a defined period in accordance with local regulations and guidelines. In this sense, we mention that the data processed by the cookie modules used to provide online behavioral advertising, to personalize our services for you and to allow the distribution of our content on social media sites (distribution buttons intended to display the site), will be kept for a maximum period of 5 years from their collection, based on your consent.

The rights of the persons concerned

In accordance with the GDPR, you have a number of rights regarding the personal data that DAILY CODE processes:

A. The right of access to processed data - you have the right to access the personal data we hold. The first provision of information will be done without charging any kind of fee. If you still need copies of the information already provided, we may charge a reasonable fee taking into account the administrative costs of providing the information. Evidently unfounded, excessive or repeated requests may not receive a response.

B. The right to rectification of data - you have the right to request that your data be rectified if it is inaccurate or out of date and/or to complete it if it is incomplete. If you have an account, you can adjust/modify your own data through the "My Account" function.

C. The right to data deletion ("the right to be forgotten") - in some cases, you have the right to obtain the deletion or destruction of your data. This is not an absolute right, because sometimes we may be forced to keep your data for legal reasons.

D. The right to restriction of processing - you have the right to request the restriction of the processing of your data. This means that the processing of your data is limited, so that we can keep the data, but not use or process it. This right applies in specific circumstances provided by the GDPR, namely: the accuracy of the data is contested by the data subject (that is, you), for a period that allows us to verify the correctness of the data; the processing is illegal and the person concerned (that is, you) requests the restriction of their use; DAILY CODE no longer needs data for processing, but they are requested by the data subject (that is, you) to establish, exercise or defend legal claims.

E. The right to data portability - you have the right to move, copy or transfer the data that interests you from our database to another. This applies only to the data you have provided, when the processing is based on your consent or on the basis of a contract and is implemented by automatic means.

F. The right to object - you can object at any time to the processing of your data when such processing is based on a legitimate interest.

G. The right to withdraw consent at any time - you can withdraw your consent regarding the processing of your data when such processing is based on consent. The withdrawal of the consent does not affect the legality of the processing based on the consent before its withdrawal.

H. The right to file a complaint with the competent supervisory authority - you have the right to file a complaint with the data protection authority in your country of residence or domicile to challenge the data protection practices offered by DAILY CODE.

I. The right to object to the processing of your data for marketing purposes - you can unsubscribe or opt out of our marketing communication at any time.

J. The right to disable cookies - you have the right to disable cookie modules. Internet browser settings are usually programmed by default to accept cookies, but you can adjust them by changing the browser settings. A series of cookie modules are used to increase the usability or functionality of websites/applications; therefore, disabling cookies may prevent you from using certain parts of our sites or applications.

You can exercise any of these rights regarding the personal data that DAILY CODE processes by sending us a simple request. In such a situation, it is very possible to request a proof of your identity.

Legal requirements

We access, store and provide your information to regulatory authorities, law enforcement agents or other similar entities:

- In response to a request of a legal nature, when we consider, in good faith, that the law requires us to do so;

- When we consider, in good faith, that it is necessary to: detect, prevent and respond to acts of fraud, unauthorized use of any material belonging to us, violations of our terms or policies or other harmful or illegal activities.

The personal data we receive from/about you may be accessed and stored for a longer period of time when they are the subject of a legal request or legal obligation, a government investigation or investigations regarding possible violations of the terms or our policies.

Processing security

DAILY CODE has adopted technical and organizational data processing measures, updated in accordance with GDPR requirements, with the aim of protecting your personal data against any actions of unauthorized access, improper use or disclosure, unauthorized modification, destruction or accidental loss. All DAILY CODE employees and collaborators, as well as any third parties acting on our behalf and on our behalf, are obliged to respect the confidentiality of your personal data and GDPR requirements.

Liability disclaimer

The DAILY CODE website may contain links to other sites and/or other web pages that are not our property. Therefore, DAILY CODE does not assume any responsibility regarding the content of these sites and, therefore, cannot be held responsible for the content, advertising, goods, services, software, information or other materials available on or through through these sites.

DAILY CODE will not be responsible for the loss of personal data, for any type of negative effects on visitors' personal data or for other moral or patrimonial damages caused by access to the respective sites.
